Mmiliki Palm Beach kurudi mahakamani

SIKU moja baada ya kutekelezwa kwa agizo la Waziri wa Ardhi, Nyumba na Maendeleo ya Makazi, Prof. Anna Tibaijuka la kuvunja uzio uliowekwa katika eneo la wazi kwenye kiwanja namba 1006 kilichopo Palm Beach, Dar es Salaam, anayedai
mmiliki wa eneo hilo, Bw. Taher Muccadam ameendelea kuweka msimamo wake wa kurudi mahakamani.

Bw. Muccadam ambaye kabla ya kuvunjwa kwa ukuta huo alijigamba kumburuta mahakamani, Prof. Tibaijuka kwa madai kuwa kutekelezwa kwa agizo lake ni ukiukwaji wa amri ambayo iliwahi kutolewa na mahakama kuwa yeye ndiye mmiliki wa eneo hilo.

Hata hivyo, wakati akijigamba kwenda mahakamani, waziri huyo alimjibu kwa kusisitiza msimamo wake wa kutekeleza agizo alilolitoa wakati akitembelea maeneo ya wazi ya jiji la Dar es Salaam Desemba 14, mwaka huu, kuwa lazima maeneo hayo yaachwe na kuwekwa bustani, ili kila Mtanzania aweze kufurahia.

"Mahakama zipo kwa ajili ya watu wote, hata serikali nayo pia inaweza ikashtakiwa, hivyo kama ana vielelezo vya kiwanja hicho na kama anayo hati ya kiwanja hicho awahi mahakamani tutakutana. Sikukurupuka kufanya hayo maamuzi kwa kuwa nimepitia faili la kiwanja hicho na kama anayo hati basi ni feki," alikaririwa Prof. Tibaijuka wakati akizungumza na Majira kuhusu kusudio la mlalamikaji huyo la kwenda mahakamani.

Akizungumza jana na Majira, Bw. Muccadam alisema kuwa kuvunjwa kwa ukuta katika kiwanja chake ni kielelezo cha kutoheshimiwa kwa amri zinazotolewa na mahakama, hivyo anatarajia kurejea huko kwa ajili ya kutafuta haki ya kiwanja chake.

"Nitakwenda mahakamani kwa ajili ya kudai fidia...nilimilikishwa kiwanja hicho kihalali na nilikuwa na kibali cha kujenga jengo la gorofa 10 hivyo makucha aliyoonesha Tibaijuka ni kudharau mhimili wa mahakama," alisema Bw. Muccadam.

Mbali na hilo pia alilalamikia hatua ya kuvunjwa kwa ukuta huo nyakati za usiku lalamiko ambalo linazua maswali mengi kwa kuwa ukuta huo nao unadaiwa kujengwa usiku kama ulivyovunjwa.Katika ziara ya Prof. Tibaijuka alimuru pia kuvunjwa kwa uzio uliojengwa katika eneo la wazi lililopo Ocean Road lakini pia alisisitiza kuwa hakuna mtu atakayeweza kutumia maeneo nje ya matumizi yanayoonekana ndani ya ramani.

Historia ya eneo la Palm Beach ilionesha kuwa mgogoro huo ulifikia hatua ya kufikishwa mahakamani lakini awali kilibatilishwa rasmi na Rais Mstaafu, Bw. Benjamin Mkapa mwaka 2002 na kufutwa umiliki wa hati ya kiwanja hicho na kuwa katika matumizi ya umma.

Hata hivyo, baada ya kutekelezwa kwa amri ya Waziri Tibaijuka wananchi wameridhishwa na hatua hiyo na kuwataka watendaji mbalimbali ndani ya wizara hiyo kumpa ushirikiano wa kutosha ili aweze kutimiza malengo yake na kuifanya ardhi kutumika kama ilivyokusudiwa.

  1. Huyu Mhindi hata adai kwamba mahakama iliamuru apewe kiwanja ni nani asiyejua namna wahindi matajiri walivyowashika majaji na mahakimu wetu. Hawa watu ni watu wabaya kabisa. Wameiweka nchi yetu mikononi mwao na wanaamua watakalo bila ya kujali kitu. Kwa sababu mfumo mzima wa nchi umeshikwa nao. Mipango miji, mahakama, watu wa ardhi wenyewe, wana sheria wa serikali na mawakili pamoja na wakurugenzi wote wa maendeleo mijini wako mikononi mwao sasa atasema nini huyu kwamba alipewa na mahakama. Kama alipewa ilikuwa ni kesi ya panya kumpelekea paka. Kama alikuwa amemshika hakimu na ofisa mipango miji na mawakiri wa serikali waliokuwa wanaitetea serikali na kumbe wakawa wamepewa rushwa na huyu bwana unategemea mahakama ingeliamuje. Mahakama iheshimiwe pale kunapokuwa hakuna dalili za rushwa. Na si vinginevyo. Sisi tunamshukuru sana Kikwete kwa kumteua huyu mama makini na mzalendo kwa nchi yake. Huyu mhindi angelikuwa mzalendo kweli angeweza kabisa kuachilia hilo eneo lakini kwa sababu ya jeuri ya fedha aliyonayo anajidai analalamika kwamba hakutendewa haki. Haki ni watanzania wote sio wahindi pekee yao.

  2. I think racism is poor excuse for political intereference and false propaganda. Some facts:

    -Tanzanians of Indian origin are not the only ones facing lands issues. With increase in urban populations and economic growth, there is tremendous pressure on land and land value, hence the increased interest in land.

    - If a country is to be ruled by law, the Government must respect the courts, whether they like the outcome. Would the writer like it if a Government official came to their house and decided it must be demolished because they say so. And even if you had a title deed.

    - Cheap populism is not a way to run a country. When the dust settles, the law will take its course and Government may pay huge sums of money.

    - It is also clear the certain newspapers, whose editors and owners come from the same region as Prof Tibaijuka, are practising tribalism and racism for cheap populism. You may wish to know that some of these people come from what was Rwanda, and knowing about the nature of tribal genocide in that country, it is dangerous for a Minister to be using cheap populism based on racism,tribalism and any form of prejudice.

    -There is a reason why Govt has set up TIC and other investment protection. One of the reasons was that Govt officials and Ministers used to disrespect law and destroy/nationalise and take people's property. Are we now repeating the mistakes of the 1970s?

    - Prof Tibaijuka herself was pushed out of the UN Habitat for misuse of USD 7 Million. If you recall, she organised a march by friends and family members to protest her innocence. However, the UN system stood firm as the evidence against her for damning, and so her career being destroyed by a demotion in UN, she spent money to become an MP and now practises cheap populism in Tanzania.

    - The writers and editors of newspapers who practise should remember this kind of cheap journalism is a double edged sword. People who are over 50 came from many different countries, tribes and races before indepedence, hence inciting racism is a dangerous practise.

    - Many Tanzanians of african origin, are also in court where they have stolen billions of dollars from Government and so far, they are all free. Most are from Prof. Tibaijuka;s clan, including Jonson Lukaza, his family, Malegesi, Maganda and others. Why are the journalists silent on cases not moving forward in these matters?

    - Prof Tibaijuka should not be taking about corruption as she was demoted and removed from the UN because of being corrupt and abusing funds.

    - Lastly, I do not know the developer as I am based in london. But I recall such behavior by Govt Ministers and cheap populism to take people's properties in the 1970s.

    The writer above, should be mindful. Perhaps the best way would be to take his property from his family and children and then see how much he likes Prof Tibaijuka.

    Racism and cheap politics is not acceptable in modern democratic socities!!

    It would be mean we would have to call Prof Tibaijuka as Tanzanian of Tutsu origin,former President Mwinyi of Comorian origin, Former President Mkapa a Tanzanian of Makonde origin from Mozambique...and the list goes on.....

  4. Well sir/madam FROM London! First I don't think the writers house is built on a supposed public land(meaning area designed to be playground or park etc). Secondly this same writers family don't have extra money to bribe (as your uncle did and know it's catching up with him). Thirdly these writers are doing their job as journalists, the fact that your family are caught in shit of their making doesn't mean that these guys should stop doing their job, this applies to your uncle as well the fact that he has messed up doesn't mean that Professor should stop doing her job!
    Everyone has a past I will not be suprised to know that you were once a terrorist. If she is doing a good job today who cares about yesterday?? If you once broke a mans/Ladys heart doesn't mean that you can't get married know!!

    Talking of origins, Gordon Brown is from Scotland, Nick Clegg originates from Spain Queens Husband from Greece, Queen originates from Germany but still if you stand with them infront of British public WHO DO YOU THINK THEY WILL PREFER........???? I think we should ask for Idd Amins lectures.

It seems your comments prove that you are indeed a racist person...since you promote Idd Amin as one of your idols...sadly so, but people like you belong in another time and perhaps you side with people like Tibaijuka, Hitler, Klu Klux Klan and whites in South Africa, who all promoted racism and ethnic divisions for self progress!!! Racism by africans is just as abhorrent as by any other races...over 1 million people got killed in Rwanda because of people who promote racist behavior like yourself...let us know count how many died because of Hitler and Apartheid in South Africa.. it is called crimes against humanity for a reason...

    Unless you are an expert on town planning and know how the laws for the same work, I would suggest that you are not qualified to make judgements...

    The former Prime Minister of Tanzania did the same thing I understand because he did not get a flat for his son...he tried to demolish the building...and in the end the Government had to give bak the building and pay over 10 Billion in damages...

  12. Ukweli ni kuwa tanzania tuna watu wengi wanaofaa kuwa viongozi na wenye uchungu na nchi yao.

    Mtu akaifanya kitu kwa faida ya nchi, basi wachache wanaotumia udhaifu wa watendaji wengine, basi wataanza kutoa sababu za kila aina.

    Tunaomba Prof. Tibaijuka aendelee na kazi yake, angalau apunguze wimbi la uvamizi wa viwanja vya wazi na uporaji wa ardhi ya wananchi unaofanywa na baadhi ya watendaji kwa kushirikiana na wachache wapenda unyonyaji.

    Sasa tumepata Magufuli wa pili, tunaomba wapatikane wengine kama kumi, ili tupate pa kuanzia kunyoosha mambo mbalimbali yanayoitafuna nchi yetu. Tanzania ni ya Watanzania wote, pinga ubaguzi wa aina yote, tetea masilai ya taifa kwa nguvu zote.

    Certain people had from the start been uncomfortable with Mrs Tibaijuka’s 2006 appointment to head the United Nations Office in Nairobi (UNON). According to confidential documents,Prof Tibaijuka was penalised over things that happened before she took office at UNON.

    Her days were also numbered the moment she started questioning serious fraud affecting, among other things, the procurement for the construction of a $25 million project to upgrade the UN headquarters at Gigiri in Nairobi.

    The director in-charge of UNON’s procurement, Alexander Barabanov, had been reporting directly to an Under-Secretary General at UN Head Office in New York, Angela Kane, a German national.

    The same official had formally authorised Mr Barabanov to oversee all financial and procurement services at UNON as per a letter dated May 19, 2005. So, by the time Mrs Tibaijuka assumed headship of UNON, Mr Barabanov had been in charge of procurement for a year.

    When Mrs Tibaijuka assumed office, she ordered the audit, which was to cover the period between 2004 and 2006, when UNON was headed by Mr Toepfer. When the report was released on February 28, 2008, it detailed serious fraud.

    After she received the audit report, Mrs Tibaijuka acted by separating UNON’s procurement arm from its support services. This is contained in an information circular she released on August 4, 2008. However, the head of pocurement, Vibekke Gravind, reacted by writing to Mr Ki-moon on September, 26, 2008, challenging Mrs Tibaijuka’s decision.

    Since the matter came into the limelight, observers have been questioning not just the behaviour of the secretary general, but also the roles that Germany, Russia and, apparently, Kenya have played in the matter.

    Russia has been unhappy that Mrs Tibaijuka’s effort to reform UNON appeared to target its national, Mr Barabanov. Mr Barabanov had conspired to put the Russian’s name on a gun permit list submitted to the police for the issuance of a firearm licence. However, this guy was not punished.

    A recent report by America’s Fox News discloses that Tibaijuka was under pressure to control the Russian accused by the Kenyan authorities of displaying “rude behaviour”. In her letters to the UN, Tibaijuka complained that allowing Barabanov to continue in office would entrench perceptions that the UN was fostering impunity and invite the wrath of the Kenyan authorities.

I am glad Prof.Tibaijuka has joined the conversation....despite through someone else..after all who else would be interested in such detail...at least it is good to clear perceptions with honest information....I worked for the UN and therefore know how the politics sometimes punishes people for no reason...

    There is a copy of the final demotion and audit report and events that led to the demotion of the Prof. Tibaijuka...it will be posted over the next few weeks so we can all discuss openly and Prof Tibaijuka can clear her name..and the UN can reform its way to punishing people from our part of the world...because of the powerful security council members like Russia..

    Hence, given your own experience, Prof...Tibaijuka, and please note we are all happy to have a experience and educated person like you being part of our government,you should get all the facts and laws before punishing people...after all that is what people like Mugabe, Mobutu and Botha have done..inspired people to do the wrong things for the wrong cause...

    Law and justice before law should guide society. .

  16. Mhh is this UN topic benefits us. Mama Tibaigana please increase effort,Asia and Tanzanian African are looting land. Please come to Arusha and see poor peoples who own houses are not allowed to repair them until they bring a plan to build a four storage house. This is planned by rich African/Asian and Municpal Officials and government leaders to loot peoples property in cheap price. Mama Tibaigana keep it don't listen to racism,tribalism which is aimed to discourage you.

  17. Mchafueni Mama Tibaijuka kwa jinsi mnavyoweza lakini watz tupo nyuma yake! Siku zote mlikuwa wapi kusema madhambi hayo mpaka anyooshe mkono wake uwaume ndiyo mseme? Hizi tunajuwa ni nongwa za kunyamg'anywa maeneo yenu na mengine mengi mtanyang'nywa tu ili Watanzania wengi Wahindi kwa Waswahili, wenyeji kwa wageni tuyafaidi!

    Hata watalii wakija wakitaka Bustani ya Kupumzikia kama Zanzibar kweli tukose kuwapeleka kisa kuna watu kama Maccadam?!

    Huko UN kwenyewe kuna scandal nyingi hii ya Mama Kama mnaieleza na kama kweli itakuwepo, ni cha mtoto! Kaangalieni ya Kina Koffi Annan na MAfuta na Chakula Program ya Iraq. Ukistaajabu ya Musa utayaona ya Firauni!

    Maccadam akathibitishwe Mahakamani katika mchezo ulio msafi ili tuamini kweli eneo hilo ni lake. Na sisi Mama Tibaijuka atatuthibitishia kuwa hilo eneo ni la Watanzania wote na si la Mtanzania mmoja!

    Tusitumbukize nyongo ya ukabila rangi na dini kama mtoa maoni wa pili anavyotaka kutupeleka. Tanzania yoote hii ni ya kwetu na kila Mtanzania ana haki sawa mbele ya rasilimali zetu na sheria!

    Maccadam Nenda kashitaki Mama atakuja kujibu Mahakamani! Na kama haki unayo utapewa na Watz tupo radhi kukulipa fidia ikibainika eneo ni lako! Ila usitumie hela na Majaji/mahakimu wetu siku hizi huko juu naamini hawahongeki wala hawana upendeleo. Watatusaidia kujuwa ukweli halisi upo wapi!

  18. Reliable Sources have confirmed that Muccadam has not paid any money to original title holders--Nilaben G Patel AND Shantaben N Patel-- just wonder whether he is a cowboy advocate or what--trying to grab lands to which he has no authority!!Corruption must be destroyed in Tanzania!!
